So, we must inform you that you have an economic operator in Poland that say’s this product does not need to be type approved. According to regulation 168/2013, all vehicles that meet the criteria set out in Annex I to this regulation must be type-approved in accordance with the provisions of this regulation. The exceptions are vehicles specified in Art. 2 paragraph 2, which are outside the scope of this regulation. In case of the vehicles you specify, if the R point is above 540 mm (Article 2 (2) of Regulation 168/2013), it falls within the scope of this regulation and therefore a type approval certificate is required. We have several distributors who place on the market products which, in our opinion, must be type-approved according to regulation 168/2013. But the distributer ask why are we asking type aprovals, becouse they don't have to be type aproved, because in Poland these products are allowed on the market without type approval.
