TAOTLUSED
1. Kohustada RHS § 461 lg 2 ja § 110 lg 5 alusel hankijat esitama või RHS § 194 lg 10
alusel edastada Osaühingule Balti Intermed:
AB Medical Group Eesti osaühingu pakkumuses esitatud
operatsioonilaua tehnilised dokumendid või kasutusjuhendid või muu
tootja poolt väljastatud tehniline andmestik, mis tõendab pakutava toote
vastavust.
2. Rahuldada Osaühing Balti Intermed vaidlustus ja tunnistada kehtetuks
Sihtasutus NARVA HAIGLA otsused, millega tunnistati Osaühing Balti
Intermed pakkumus mittevastavaks ning AB Medical Group Eesti osaühing
pakkumus vastavaks ja edukaks.
3. Jätta menetluskulud Sihtasutus NARVA HAIGLA kanda.
ASJAOLUD
1. 12.07.2023 avaldas Sihtasutus NARVA HAIGLA (hankija) avatud hankemenetlusena läbi
viidava riigihanke „Universaalse ortopeedilise operatsioonilaua ostmine“ (vr 267366)
hanketeate (HT) ja riigihanke alusdokumendid (RHAD). Hankija eesmärk on osta

T: 614 1858,
[email protected], www.pwclegal.ee
ortopeedilist operatsioonilauda, mis vastab Tehnilise Kirjelduse (TK) nõuetele. Ainsaks
hindamise kriteeriumiks on pakkumuse kogumaksumus.
2. Pakkumuse esitamise tähtpäevaks – 31.07.2023 – esitas pakkumuse kaks ettevõtjat:
1) Osaühing Balti Intermed (vaidlustaja) – pakkumuse maksumus 97 000 EUR;
2) AB Medical Group Eesti osaühing (kolmas isik) – pakkumuse maksumus 99 690 EUR.
3. 11.08.2023 tunnistas hankija vaidlustaja pakkumuse mittevastavaks. Kolmanda isiku
hankelepingu.
PÕHJENDUSED
(I) Vaidlustajal on vaidlustuse esitamise õigus
4. Riigihangete vaidlustusmenetluses kehtib pikaajaline ja üldtuntud praktika, mille kohaselt
isikute hankemenetluses osalemise ainus seaduslik eesmärk on majanduslik huvi sõlmida
hankeleping.
Seega
on riigihanke vaidlustusmenetluses kaitstav õigushüve õiguspärane hankelepingu sõlmimise
5. Vaidlustaja vaidlustab enda pakkumuse mittevastavaks tunnistamise – vt ptk (II). Samas
isegi kui hankija on vaidlustaja pakkumuse mittevastavaks tunnistanud õiguspäraselt, on
vaidlustajal õigus taotleda kolmanda isiku suhtes tehtud otsuste õiguspärasuse kontrolli.
Nimelt saab vaidlustaja konkurendi pakkumuse vastavust vaidlustades „konkreetse kasu“.
6. Euroopa Kohus on laiendanud kaebeõigust olukorras, kus vaidlustaja huviks on saavutada
uus hankemenetlus ja uus võimalus hankelepingule konkureerida. Kohus selgitas, et kui kaks
pakkujat esitavad üksteise hankest kõrvalejätmise eesmärgil kaebused, „on mõlemal pakkujal
huvi konkreetse lepingu vastu.
poolt on mõlemal menetlusosalisel võrdväärne õiguspärane huvi teiste konkurentide
1 VAKO 4-18/192029, p 9.
2 EKo C‑689/13, p 26-28.
2/7
pakkuja pakkumus lükataks tagasi. Direktiivis kasutatud mõiste „konkreetne leping“ võib
niisugusel juhul viidata uue hankemenetluse korraldamisele.3
8. Praegusega sarnases kaasuses on vaidlustuse esitamise õigust kinnitanud ka VAKO:
„Euroopa Kohtus tunnustab riigihankes kahe pakkumuse esitamisel vaidlustaja
esitamise õigus Kolmanda isiku pakkumuse vastavaks tunnistamise otsusele, hoolimata
tunnistamise otsus.
eelnevalt tuvastanud vaidlustaja enda pakkumuse mittevastavuse.5
otsus on olnud õiguspärane.
(II) Vaidlustaja pakkumuse tagasilükkamise otsus on õigusvastane
11. RHS § 3 kohaselt peab hankija kohtlema kõiki pakkujaid võrdselt. Hankija on tunnistanud
Samas kolmanda isiku
pakkumuses esitatud operatsioonilaud võimaldab kasutusjuhendi kohaselt maksimaalset
koormust kuni 360 kg. Vaidlustaja pakutav toode seejuures ületab kasutusjuhendi kohaselt
kolmanda isiku pakutava toote maksimaalset lubatavat kaalu. Ometi on hankija lükanud
vaidlustaja pakkumuse tagasi, kuid pole teinud samasugust etteheidet kolmanda isiku
pakutavale operatsioonilauale. Hankija on TK p 2.8 ja 5.1 vastavuse kontrollimisel kohelnud
pakkujaid ilmselgelt ebavõrdselt ja eelistanud põhjendamatult kolmanda isiku pakkumust.
12. Mittevastavaks tunnistamise otsus on tervikuna põhjendamata ja pealiskaudne. Nii nähtub
näiteks TK p 7 osas hankija otsuse lisast kommentaar „sääreosa?“. See ei ole aga
mittevastavus, vaid küsimus või kahtlus. Hankija ei ole küsinud vaidlustajalt mitte ühegi
väidetava mittevastavuste osas selgitusi ega lisatõendeid.

(III) Kolmanda isiku pakkumus ei vasta RHAD-le
3.1. Taotlus pakkumuse vastavuse tõendamiseks esitatud dokumentide
edastamiseks vaidlustajale
13. Kolmas isik on tootja TRUMPF/HillRom operatsioonilaua ametlik edasimüüja Eestis ning
14. RHS § 194 lg 10 kohaselt on vaidlustusmenetluses menetlusosalisel õigus tutvuda
vaidlustusmenetluses esitatud dokumentidega.
vastavust). Eelduslikult on selliseks tõendiks kolmas isik esitanud eelkõige toote
kasutusjuhendid.
15. Toote vastavust kirjeldavad kasutusjuhendid ei ole ärisaladus. Kasutusjuhenditel puudub
Meditsiiniseadme kasutusjuhendid on vabalt veebist
Seega on kasutusjuhendid
avalik teave, mitte tootja või edasimüüja ärisaladus. Seda, et TruSystem 7500
operatsioonilauda puudutavad kasutusjuhendid on vabalt erinevates Euroopa Liidu keeltes
kättesaadavad, tõendavad ka vaidlustuse lisad.
3.2. Kolmanda isiku operatsioonilaud ei vasta maksimaalsele patsiendi
kaalunõudele
16. Kolmas isik on pakkunud operatsioonilauda TruSystem 7500, tootja TRUMPF Medizin
Systeme GmbH + Co, mis kuulub kontserni HillRom Holdings Group:
7 RKTKo 09.12.2008, 3-2-1-103-08, p 20.
4/7
17. TK p 2.8 kohaselt peab samba ja sobiva lauaplaadi kombinatsioonis olema lubatav
maksimaalne patsiendi kaal vähemalt 400 kg. TK p 5.1 kohaselt peab lauaplaadi ja samba
kombinatsioonis on lubatav maksimaalne patsiendi kaal vähemalt 400 kg. Operatsioonilaua
TK-s on
1) operatsioonilaua plaat koos neljaosalise jalaosaga (LegMaster) (TK p-d 5, 6, 7).
Kombinatsioon sammas, universaalne lauaplaat, neljaosaline jalaosa LegMaster on
esitatud vaidlustaja pakutava toote ingliskeelse kasutusjuhendi punktis 3.8.5 versioon 6
(lk 29). Maksimaalne kaal on selles kombinatsioonis 135 kg (vt kasutusjuhendi lk 27),
mitte aga nõutud 400 kg;
2) operatsioonilaua plaat kombinatsioonis venitusseadme komplektiga (TK p 8).
ingliskeelses kasutusjuhendis teadmata põhjusel esitatud, kuid saksakeelses
kasutusjuhendi punktis 13.1.6 (lehekülg 50) on see märgitud 160 kg, s.t vähem kui TK-
s nõutud 400 kg;
3) operatsioonilaua plaat seljaosaga õlaoperatsioonideks rannatooli asendis (TK p 9).
Kombinatsioon sammas, universaalne lauaplaat ja õlaoperatsioonide seljaosa on inglise
keelse kasutusjuhendi punkti 3.9.3 (lehekülg 32) kohaselt 180 kg, mitte TK-s nõutud
400 kg.
saksakeelse kasutusjuhendi (lisa 2). Nende kaudu on VAKO-l võimalik hõlpsalt veenduda,
5/7
20. Kasutusjuhendi lk-l 20 on hoiatus: „Do not exceed the permissible load“, s.t ära ületa
lubatavat koormust. Maksimumkaalu ületamisel võib operatsioonilaud ümber kukkuda ja
põhjustada tõsiseid vigastusi patsiendile või personalile. Ülekoormusega võivad kaasneda
operatsioonilaua elektroonika rikked ja põhjustada füüsilisi kahjustusi operatsioonilaua
mehaanilistele osadele.8 Kasutusjuhendi leheküljel 48 (tehnilised andmed) kohaselt on,
olenevalt operatsioonilaua varustusest, maksimaalne koormus kuni 360 kg. Mitte kusagilt
kasutusjuhendist ei tulene maksimaalne kaal vähemalt 400 kg.
tohtinud hankija pakkumust vastavaks tunnistada. Otsuste järgnevuse põhimõttest
tulenevalt on seega õigusvastane ka kolmanda isiku pakkumuse edukaks tunnistamine (RHS
§ 114 lg 1 ls 2).
MENETLUSLIKUD KÜSIMUSED
22. Vaidlustuse tähtaegsus. Hankija tegi otsused teatavaks 11.08.2023. Vaidlustus on
tähtaegne (RHS § 189 lg 1).
23. Riigilõiv. Vaidlustaja on tasunud riigilõivu 640 eurot (RLS § 258 lg 1 p 1) (lisa 3).
24. Esindusõigus. Vandeadvokaat Erki Fels kinnitab, et on vaidlustaja volitatud esindaja.
25. Vaidlustuse läbivaatamise viis. Vaidlustaja on nõus asja lahendamisega kirjalikus
menetluses.

3.5 Hook couplings
The hook coupling is a separable connecting point between the
operating tabletop and the tabletop sections. Each hook coupling
is made up of a fixing point or a clamp. The design of the fixing
point determines which clamp can be attached. The hook
couplings are designed so that only certain combinations are
possible, and the configuration of the operating tabletop is always
mechanically secure. There are 3 different fixing points and
clamps, which can be combined as follows:
Mount

3.6 Side rails
The operating tabletop is equipped with side rails. Accessories can
be attached to the side rails. The accessories approved by
Trumpf Medizin Systeme are listed in the Compatibility Matrix 2).
The accessories must be taken into account when determining the
total patient weight (see Chapters 3.8, 3.9).
The side rails are available in various country-specific standards
and differ in their dimensions. The side rail according to the US
standard may also have an additional safety mechanism [A]/[B] at
the end of the side rail. The securing device prevents loose
accessories from sliding off the side rail.

Description
3.8 Maximum load capacity U24, U26, ST26
WARNING
Do not exceed the permissible load.
• Do not exceed the permitted load capacity for the operating
table. If the permissible load is exceeded, the mobile operating
table may tip over and cause serious injuries to the patient or
staff.
• In general, overloading the operating table can lead to a failure
of electrical functions and cause material damage to
mechanical parts.
The operating table is approved for a maximum patient weight of
360 kg / 794 lbs. The maximum load on the operating table may
only be applied, if the conditions in Chapter 3.8 are met.
Consult Trumpf Medizin Systeme regarding the permissible load in
any configuration of the operating table other than that described
in these instructions for use.
The load comprises the weight of the patient and the net weight
of the accessories. An additional accessory on the operating
tabletop therefore reduces the permissible patient weight. The
net weight of the accessory must be deducted from the
permissible patient weight.
Regardless of the load on the operating table, the load on the
individual accessories and the tabletop sections must be complied
with. The requirements are indicated in the instructions for use of
the products.
The maximum patient weight applies for an evenly loaded
operating tabletop (surface load).
Restriction
The lightweight, single-piece leg section [A] (#1790121) can be
A used at all hook coupling points with double rails, taking into
account the restricted patient weight. The lightweight, single-
piece leg section is generally only approved for a patient weight of
up to 135 kg / 298 lbs. A different leg section must be used on the
operating table for a heavier patient.

3.9 Maximum load capacity for U14
The maximum load on the operating table may
only be applied, if the conditions in Chapter 3.9 are met.
Consult Trumpf Medizin Systeme regarding the permissible load in
any configuration of the operating table other than that described
in these instructions for use.
7990020_030_02 – 2078415 – 2021-03-02 29
Description

Description
3.11 Use with imaging systems
The operating table is approved for use with an X-ray device. The
operating table column is not radiolucent.
A
The operating tabletop is radiolucent between the left and right
struts outside the operating table column. The X-ray area at the
B head [A] and foot [B] end depends on the position of the operating
tabletop in the longitudinal orientation. If the operating tabletop is
moved in the direction of the foot end, the X-ray area at the foot
end of the operating tabletop increases. If the operating tabletop
is moved in the direction of the head end, the X-ray area at the
head end of the operating tabletop increases.
The instructions for use of the product used must be consulted in
order to determine the radiolucent area of the tabletop sections
or accessories.
Avoid wrinkling the pad and other materials lying on it (towels,
underlays) in order to keep image artifacts to a minimum.
U24, U26, ST26 The U24, U26 and ST26 operating tabletops have rails for the
attachment of an X-ray cassette (size 14 inch) on the inside of the
back section struts. The X-ray cassette can be pushed through
under the seat section with the U24 and U26 versions of the
operating tabletop.

position, lift the patient's affected body parts. Any wrinkles or
shearing forces that have developed will be reduced.
– The patient may not climb onto or down from the operating
table over the back sections or attached tabletop sections.
Improper weight distribution can result in tabletop sections
breaking off the operating table, or cause the operating table
with the mobile operating table column to tip over. Patients
may only get on or off in the column area via the seat section.
Do not sit on the back section or attached tabletop sections.
– The patient's extremities must not extend beyond the end of
the operating tabletop in the longitudinal direction. This does
not apply in the case of accessories designed for this purpose.
Operating table functions:
– Carry out all patient repositioning in a controlled and
responsible manner. Monitor all of the operating table’s
motorized movements to prevent the patient being
endangered or material damage occurring as a result of a
collision. Stop the function immediately before a dangerous
situation arises. Ensure that the adjustment ranges on the
operating table are not obstructed.
38 7990020_030_02 – 2078415 – 2021-03-02
Use
– The cables and tubes to the patient must not be placed under
tension or crushed during the operating table's motorized
movements. Stop the function in good time.
– There is a risk of crushing for the user between mobile parts of
the operating table. Stop the function immediately before a
dangerous situation arises.
– The operating table maintains the position set by the user. A
change in position will only occur by means of a proactive
action by the user.

this case, when the leg sections are spread and above one
another, there is a risk of the leg sections colliding. Stop the
function before any collision and adjust the leg sections so
that they are not on top of each other.
After a few seconds without pressing any key, it will
automatically switch back to the collective adjustment of the
joints.

Maßnahmen zwingend erforderlich sein.
WARNUNG

Produkte enthalten.

VORSICHT
Patientengefährdung durch Kollision!
Klemmgefahr für den Bediener!
Der OP-Tisch erkennt in der Umgebung keine Objekte. Kollisionen

1. Die Längsverschiebung ist gesperrt, sobald der Extensions-
Adapter an der OP-Tischplatte eingehängt ist. Der
Anwesenheitssensor ist aktiv.
2. Die Längsverschiebung kann eingeschränkt sein, wenn die
Beinplattengelenke oder unteren Rückenplattengelenke nach
unten geneigt sind. Der Stellbereich für die Längsverschiebung
ist abhängig vom Neigungswinkel der Gelenke. Wird ein
größerer Stellbereich benötigt, müssen die Gelenke nach
oben verfahren werden.

abnehmen.
