Saatja: TRANSLATION ET Terminology <[email protected]> Saadetud: 05.08.2021 15:16 Adressaat: EPA yldpatendiamet <[email protected]> Teema: terminiküsimus: litsentsid/litsentseerimine Tähelepanu! Tegemist on välisvõrgust saabunud kirjaga.Tundmatu saatja korral palume linke ja faile mitte avada. Tere! Lugupidamisega Anu Vesberg tõlkija/terminoloog 1) voluntary licence - vabatahtlik litsents? EN def: authorisation given by a patent holder to a generic company, allowing it to produce a patented article, such as a medicine, as if it were a generic 2) voluntary licencing - vabatahtlik litsentseerimine? EN def: arrangement whereby a patent holder allows others to manufacture, import, and/or distribute the product covered by its patent Märkus: 1. This includes medical products and is particularly topical in discussions on how to make medicines more readily available in the context of pandemics, such as COVID 19. 2. Voluntary licensing is where patent holders willingly allow the transfer of the technology and/or know-how related to their patents. Patent holders' rights may be superseded in certain cases - for example under the TRIPS Agreement - through the use of compulsory licensing IATE:2224937. 3) compulsory licence - kohustuslik litsents? EN def: authority granted by a government, as an exception to patent rights1, allowing someone else to produce a patented product or process without the consent of the patent owner Märkus: The rights concerned are to make, use, sell or import a product under patent (i.e. a patented product or a product made by a patented process). 'In current public discussion, this is usually associated with pharmaceuticals, but it could also apply to patents in any field'. This is allowed under the WTOs TRIPS (intellectual property) Agreement provided certain procedures and conditions are fulfilled. [4) compulsory licencing - kohustuslik litsentseerimine? EN def: act of authorising1 companies or individuals other than the patent owner to use the rights of the patent2 without the permission of the patent owner Märkus: The authorisation, which takes the form of a 'compulsory licence' IATE:772812, is granted by a 'competent authority'. 2. The rights concerned are to make, use, sell or import a product under patent (i.e. a patented product or a product made by a patented process). This is allowed under the WTOs TRIPS (intellectual property) Agreement provided certain procedures and conditions are fulfilled.]
