Ares(2020)3685425 - 13/07/2020 EUROPEAN COMMISSION DIRECTORATE-GENERAL JUSTICE AND CONSUMERS Directorate A: Civil and commercial justice Unit A.1 : Civil justice Brussels JUST.A.1/JG/im/4224388 Subject: Evaluation of Regulation (EC) No 805/2004 of the European Parliament and of the Council of 21 April 2004 creating a European Enforcement Order for uncontested claims (EEO Regulation) Dear Madam/Dear Sir, The Commission has launched the evaluation of Regulation (EC) No 805/2004 creating a European Enforcement Order for uncontested claims (the EEO Regulation). The Regulation applies since 21 October 2005 in all Member States but Denmark. It is the first legal instrument that abolished the exequatur procedure in the EU, under the condition that the minimum procedural standards provided by the Regulation, relating to the service on the defendant, the provision of information to the defendant and the availability of a review of the judgment in exceptional cases, are met. Several other subsequent legal instruments apply the same mechanism, notably Regulation (EC) 1896/2007 creating the European Order for Payment Procedure and Regulation (EC) 861/2007 establishing the European Small Claims Procedure. With the adoption of Regulation (EU) 1215/2012 on jurisdiction, the recognition and enforcement of judgments in civil and commercial matters (Brussels I Regulation recast) exequatur has been generally abolished in civil and commercial matters, albeit on different terms than those set out in the EEO Regulation. In these circumstances, the Commission decided to carry out an evaluation of the EEO Regulation, focusing on the added value of its continued application in parallel to the Brussels I (recast) Regulation. The Commission asks the Member States to provide any available evidence and data on practical application of the EEO Regulation and express their opinions on the future of the EEO Regulation. Liikmesriikide poole on pöördunud Euroopa Komisjoni tsiviil- ja kaubandusõiguse direktoraadi tsiviilõiguse osakonna juht Andreas Stein. Hr Andreas Stein märgib oma kirjas, et Euroopa Komisjon viib läbi Euroopa täitekorralduse määruse hindamist, keskendudes määruse lisandväärtusele, eelkõige pärast Euroopa Parlamendi ja nõukogu määruse (EL) nr 1215/2012, kohtualluvuse ning kohtuotsuste tunnustamise ja täitmise kohta tsiviil- ja kaubandusasjades (uuesti sõnastatud; nn Brüssel Ia määrus) kehtima hakkamist. Seoses hr Andreas Steini kirjaga ootame kohtunike seisukohti selle kohta: 1) kas eelistaksite, et täitekorralduse määrus jääks kehtima ka edaspidi või piisaks Euroopa täitekorralduse määruse kohaldamisalas olevates tsiviil- ja kaubandusasjades tehtud kohtulahendite piiriüleseks ringlemiseks Euroopa Liidus Teie hinnangul Brüssel Ia määrusest ja eelistaksite täitekorralduse määruse kehtetuks tunnistamist; 2) ettepanekuid selle kohta, kuidas täitekorralduse määrust parandada. Samuti on oodatud igasugune muu teave, mis on oluline täitekorralduse määruse toimimiseks, muuhulgas soovime teada, milliseks on Teie kogemuse pinnalt kujunenud Euroopa täitekorralduse määruse tähtsus ja kasutatavus pärast Brüssel Ia määruse kehtima hakkamist.
