To the extent that the third party has already submitted to the contracting authority the justifications, evidence and explanations concerning the compliance of its tender with the prohibition of cross-subsidisation as well as the justification of the value of its tender, and the review committee has access to them, the third party will not repeat them. 2. By examining the justifications, evidence and explanations submitted by the third party regarding its tender, the review committee can unequivocally ascertain that the appeal has been submitted on incorrect assumptions, that it contains misleading ISO 9001:2015 certified CAGE Code: L0FQ3, DUNS:203520929  PROPRIETARY & CONFIDENTIAL facts taken out of context and that it has no connection to real-life facts. Therefore, the appeal must be dismissed and the contested decision must be upheld. 3. In connection with the opponent's request for information set out in clause 50 of the appeal, the third party emphasises that Annex 1 to the reply submitted to the contracting authority in the course of the inspection procedure conducted by the contracting authority (presumably also submitted by the contracting authority to the review committee) and the Excel spreadsheet (the file names of both documents is emphasized "CONFIDENTIAL") are strictly confidential and cannot be submitted to the opponent to any extent. 4. These documents contain a vital business secret for a third party, the disclosure of which to the opponent could significantly damage the commercial prospects of the third party, and on a wider global scale outside the contested public procurement. In any event, the third party shall, if necessary, request the possibility of providing further explanations in relation to the confidentiality of the documents in order to provide justifications. 5. As the appeal contains several claims regarding facts that have already been discussed in the previous appeal proceedings, the third party asks the review committee to verify the deadline for filing such claims, taking into account the fact that in their positions the deadline for filing a review may already be upon the expiry of the deadline for filing a review of previous decisions. Kuivõ rd kolmas isik on esitanud põ hjendused, tõ endid ja selgitused oma pakkumuse vastavuse kohta ristsubsideerimise keelu jä rgimise kui ka oma pakkumuse maksumuse põ hjendatuse kohta juba hankijale ning vaidlustuskomisjonil on võ imalik nendega tutvuda, ei hakka kolmas isik neid kordama. 2. Tutvudes kolmanda isiku esitatud põ hjenduste, tõ endite ja selgitustega oma pakkumuse kohta on vaidlustuskomisjonil võ imalik ü hesel veenduda selles, et vaidlustus on esitatud ebaõ igetel eeldustel, see sisaldab eksitavaid kontekstist vä lja ISO 9001:2015 certified CAGE Code: L0FQ3, DUNS:203520929  PROPRIETARY & CONFIDENTIAL võ etud faktilisi asjaolusid ega oma puutumust pä riseluliste faktidega. Seetõ ttu tuleb vaidlustus jä tta rahuldamata ning vaidlustatud otsus jõ usse. 3. Seonduvalt vaidlustuse p-s 50 toodud vaidlustaja teabenõ udega rõ hutab kolmas isik, et hankija lä biviidud kontrollmenetluse raames hankijale esitatud (eelduslikult hankija poolt ka vaidlustuskomisjonile esitatud) vastuse Lisa 1 ning Exceli tabel (mõ lema dokumendi faili nimes on rõ hutatud „CONFIDENTIAL“) on rangelt kon�identsiaalsed ega kuulu mis tahes ulatuses vaidlustajale esitamiseks. 4. Nimetatud dokumendid sisaldavad kolmanda isiku jaoks vitaalset ä risaladust, mille avaldamine vaidlustajale võ ib kahjustada oluliselt kolmanda isiku ä rilisi vä ljavaateid ning seda laiemas ü lemaailmses mastaabis vaidlustatud riigihanke vä liselt. Igal juhul taotleb kolmas isik vajadusel tä iendavate selgituste esitamise võ imalust seonduvalt dokumentide kon�identsiaalsuse tarvis põ hjenduste esitamiseks. 5.
