Main Street, Suite 630 Butte, Montana 59701, USA Meie nr Unilateral Termination of Public Procurement Contract No. 295714 Dear Representative of Resodyn Acoustic Mixers Inc, A public procurement contract No. 295714 was concluded on 5 September 2025 between Tallinn University of Technology (hereinafter referred to as “TalTech”) and Resodyn Acoustic Mixers Inc (hereinafter referred to as the “Contracting Partner”), the subject of which is the acquisition of an acoustic resonance mixer. In accordance with Clause 4.3 of the Contract, the deadline for performance of the Contract was 5 December 2025. On 1 December 2025, TalTech contacted the Contracting Partner requesting confirmation regarding the timely performance of the contract. In January 2026, the Contracting Partner requested the delivery address and invoice details, which TalTech provided on the same day. On 29 January 2026, TalTech again contacted the Contracting Partner requesting information on the current stage of the equipment delivery process. Unfortunately, TalTech has not received any response to the above communications. As of 4 March 2026, the contractual performance deadline has been exceeded by 89 calendar days, and the Contracting Partner has neither provided information regarding the performance of the contract nor fulfilled its contractual obligations. Failure to perform the contractual obligations within the agreed deadline constitutes a fundamental breach of the Contract. Pursuant to Clause 6.10 of the Contract, TalTech hereby notifies you of the unilateral termination of Public Procurement Contract No. 295714. The Contract shall be considered terminated as of the date of this notice.
