Dear Minister,
In February 2025, I wrote to you as we were about to begin our work on revising the EU’s
legislative framework for public procurement. At the time, I invited you to share your thoughts and
suggestions with me, convinced that this revision could only succeed if we worked together. And I
would like, first and foremost, to thank you for your commitment throughout this process, as well
as for the valuable input you have provided.
I am pleased to inform you that the Commission adopted today its legislative proposal for a new
Public Procurement Regulation, delivering on the commitment made by President von der Leyen.
This is a significant and, I believe, ambitious step in the process of reforming the Union’s public
procurement rules, which directly addresses the two objectives I set out at the beginning of the
process: simplification and making public procurement an efficient public investment instrument.
On simplification, we have chosen to be bold.
We propose to replace three Directives, as well as provisions scattered across various sector-
specific acts, through a single Regulation that would be directly applicable throughout the Union
and consolidate the rules on public procurement for all public buyers and concessions. This
represents a genuine “deep cleaning” of our rules, and I believe it is the only way to effectively
ensure legal certainty and coherence as well as reducing administrative burden for public buyers
and businesses.
The choice of a single Regulation is key to ensure a simplified, coherent and harmonised
framework for public procurement while at the same time awarding public buyers greater freedom
and flexibility. This choice fully respects the principle of subsidiarity, yet contributes to
strengthening the Single Market, which I know is an objective we all share. A Regulation allows
us to establish common legal standards and procedural guarantees and at the same time give public
buyers a lot more freedom to design public procurement procedures according to their needs.
We also propose, and this is essential, the creation of a single European Digital Marketplace for
public procurement: a network of interoperable Member States’ platforms, where public buyers

and businesses can connect and find opportunities across the Union, allowing to significantly
reduce administrative burden for companies and public buyers alike.
With the aim of making public procurement an efficient public investment tool, we have
chosen to be ambitious.
Best value for money is highlighted as the general rule for awarding contracts, so that public money
serves our public priorities, whilst preserving the flexibility that contracting authorities need. Public
buyers should consider the quality of the goods, services and works they buy. Quality in terms of
technical merit, delivery conditions or after-sales policy, or in terms of environmental sustainability
or social considerations – this is for each public buyer to decide in line with the freedom and
flexibility awarded to them. It makes public procurement a more strategic investment tool
supporting the Union’s policy objectives.
We also propose to enable public buyers, for the first time in such a systematic manner, to take into
account risks relating to security, including harmful strategic dependencies and undue influence
from third countries. Finally, given the growing geopolitical importance of public procurement, we
propose a calibrated framework for European preference, enabling public procurers to apply
preference requirements and, where the Union’s strategic interests so require, allowing the
Commission to take action at Union level, in full respect of our international commitments and
considering the specific needs of each sector.
I am convinced that this proposal reflects the ambition that our times demand. It could not have
come about without the collective work we have carried out together over the past few months. I
am now counting on your continued commitment as this proposal begins its legislative journey. I
have no doubt that, together, we will be able to see it through successfully and as quickly as
possible.
I would like to thank you once again, most sincerely, for your support and commitment throughout
this process so far, and I look forward to continuing our collaboration in the coming months.
Yours sincerely,
Stéphane Séjourné
