Dear EDPB Members, As agreed at the June meeting of its recently created task force on data protection, competition and consumer protection (TF C&C), the task force prepared a questionnaire on the cooperation between SAs and competition and consumer protection authorities at national and EU level, to be completed by every EDPB member. The short survey you will find attached is intended to provide essential input to the EDPB, specifically to the C&C task force, on cooperation patterns and experience of interplay between regulations on the ground. On the basis of your feedback and insights, the task force will elaborate a FAQ by the end of the year, providing you with good practices and indications on what to expect from such cooperation in the context of the ECJ Meta case (C-252/21) we commented at Plenary level this summer. Therefore, we kindly ask that you answer the questions in the survey attached on behalf of your supervisory authority, pursuant to Art. 51 GDPR, in your Member State. We also kindly ask that you forward the questions in the annexes to the relevant competition (Annex 1) and consumer protection authorities or bodies (Annex 2) in your Member State, and collect their answers. Please provide your answers in English. We anticipate your answer to this survey by 27 October 2023. Please send your reply by responding to this email. Many thanks! Dear Sir or Madam, Competition, consumer protection and data protection are three fields of regulation having points of interaction and jurisdictional overlaps, which we refer to as regulatory interplay (or simply interplay ) , between national authorities and consumer bodies, as well as between national and EEA authorities and bodies. Interplay between regulatory regimes can give rise to obligations of coordination and co-operation between national supervisory authorities and bodies with different responsibilities, as evident by the recent case law of the Court of Justice of the European Union (CJEU). In order to facilitate a n exchange and better co-operation on regulatory interplay between authorities and consumer bodies, the European D ata P rotection B oard (EDPB) is making a survey about co-operation, established best practices and suggestions to improve the dialogue between authorities. This survey is intended to provide essential input to the EDPB , specifically to its ’ recently created task force on data protection, competition and consumer protection ( TF C&C). On the basis of your feedback and insights , the task force will elaborate on the subject matter of co-operation on regulatory interplay , providing you with good practices and indications on what to expect from such cooperation.
