I understood that concerns were expressed by personnel that would then need to go onboard of such vessels if the vessel was categorized as Priority I for a mandatory inspection, and what would be the legal interpretation if such an inspection does not take place. Please note that the issue is not a new one and these questions have previously been raised both in relation to asbestos on board and for the Ebola virus. Article 8(2)(a) of Directive 2009/16/EC is clear in this regard and provides that in cases where “in the judgement of the competent authority the conduct of the inspection would create a risk to the safety of inspectors, the ship, its crew or to the port, or to the marine environment” a missed Priority I inspection will not be counted as a missed inspection provided that the reason for missing the inspection is recorded in the THETIS inspection database. So therefore if it is the assessment of your authorities that an inspection would give rise to such risks such an inspection does not have to be carried out but the miss and its justification should be noted in THETIS. It is very important in particular to make sure that as soon as the Covid-19 risk disappears the ship will be inspected. I hope that the above information answers your concerns.
