The questions concern the freedom of speech of judges and are in short, the following:

* What is the legal regulation in your country concerning the manner in which judges
express publicly their opinion?
* What particular restrictions are imposed on judges when expressing their views publicly?
* If there are no specific restrictions and there is only a general statement concerning restraint in public statements, what prevents legislator/courts from establishing more detailed rules?
* Is there a difference between judge’s statements concerning his or her own case and the statements concerning case of another judge? Is there a possibility to comment on the ongoing cases or do the proceedings always have to be concluded by the final decision?
* What is the practice of the courts (and notably courts’ functionaries) when there is a need to express the opinion on the changes in the judicial system by other branches of power?
* Under what conditions it is necessary for a judge to recuse himself or herself from a case after he or she made certain (public) statements?
* What disciplinary sanctions may a judge face when his or her statements are considered to be against the law?
* Is there any case-law of your respective courts with respect to the above-mentioned questions?

* Quelles sont les restrictions particulières imposées aux juges lorsqu’ils expriment publiquement leur opinion ?
* S’il n’existe pas de restrictions particulières et qu’il n’y a qu'une déclaration générale concernant la retenue dans les déclarations publiques, qu’est-ce qui empêche le législateur/les tribunaux d’établir des règles plus détaillées ?
* Existe-t-il une différence entre les déclarations d’un juge concernant sa propre affaire et les déclarations concernant l’affaire d’un autre juge ? Existe-t-il une possibilité de commenter les affaires en cours ou la procédure doit-elle toujours se conclure par une décision finale ?
* Quelle est la pratique des tribunaux (et notamment des fonctionnaires des tribunaux) lorsqu’il est nécessaire d’exprimer une opinion sur les changements apportés au système judiciaire par d’autres branches du pouvoir ?
* Dans quelles conditions est-il nécessaire pour un juge de se récuser d’une affaire après avoir fait certaines déclarations (publiques) ?
* Quelles sanctions disciplinaires un juge peut-il risquer lorsque ses déclarations sont considérées comme contraires à la loi ?
* Existe-t-il une jurisprudence de vos Cours respectives concernant les questions susmentionnées ?
