Saatja: DURR Schnutz <[email protected]> Saaja: Venice, WCCJ5 Teema: WCCJ _ Resolution / Résolution Dear Members of the World Conference on Constitutional Justice, On 7 June 2022, the Bureau of the World Conference held its 18th meeting online. While there was no majority for requests to suspend the Constitutional Courts of the Russian Federation and the Constitutional Court of Belarus under Article 9 of the Statute of the WCCJ<https://www.venice.coe.int/webforms/documents/default.aspx?pdf=CDL-WCCJ-GA(2017)010-e>, the Bureau adopted a Resolution, proposed by the Constitutional Court of Italy, which is available at the following link: https://www.venice.coe.int/webforms/documents/?pdf=CDL-WCCJ-GA(2022)003-e. Paragraph 2 of the Resolution is addressed to the Member Courts and, referring to the respect of the fundamental principles of democracy, the rule of law and human rights, requests the Members to “put in place any action and measure required in order to comply with the above-mentioned principles, which are at the heart of the World Conference on Constitutional Justice”. The Resolution does not ask for specific action taken but key judgements and international conferences or seminars can be seen as such actions because, typically, they promote these fundamental principles. In order to enable a dialogue on such actions, we propose opening a discussion in the Newsgroup of the Venice Forum, which is open to the liaison officers of all Member Courts of the World Conference (https://cs.coe.int/team21/veniceforum/default.aspx). This would allow the Members to inform others on such actions and to encourage each other. I hope that you will find this convenient. Bien qu'il n'y ait pas eu de majorité pour les demandes de suspension des Cours constitutionnelles de la Fédération de Russie et la Cour constitutionnelle du Bélarus en vertu de l'article 9 du Statut de la WCCJ<https://www.venice.coe.int/webforms/documents/default.aspx?pdf=CDL-WCCJ-GA(2017)010-f>, le Bureau a adopté une résolution proposée par la Cour constitutionnelle d'Italie, qui est disponible à l'adresse au lien suivant : https://www.venice.coe.int/webforms/documents/?pdf=CDL-WCCJ-GA(2022)003-f. La résolution ne demande pas d'action spécifique, mais vos arrêts clés et des conférences ou séminaires internationaux peuvent être considérés comme de telles actions car, généralement, ils promeuvent ces principes fondamentaux. Afin de permettre un dialogue sur de telles actions, nous proposons d'ouvrir une discussion dans le Newsgroup du Forum de Venise, qui est ouvert aux agents de liaison de tous les Cours membres de la Conférence mondiale (https://cs.coe.int/team21/veniceforum/default.aspx). Cela permettrait aux cours membres d'informer les autres de telles actions et vous s'encourager mutuellement. J'espère que ceci vous conviendra.
