We hereby wish to consult you on the attached draft aggregated emissions regarding your Member State that underpin the auctioning key, in case you see any issues, e.g. compared to the data you hold. These data have been provided to the Commission by EUROCONTROL. We also attach the presentation held in the CCC this morning FYI. Please note:  As is relevant, the data are broken down by departure Member State for the year 2018 (the country of destination is irrelevant as long as the flight falls within the EU ETS scope).  The data stem from EUROCONTROL’s EU ETS Support Facility.  The CO2 emissions by departure Member State are used to determine the auction shares by Member State for phase 4 starting in 2021.  The Brexit negotiations outcome and Swiss linking agreement will determine which of the 4 following sets would be used: - UK in – CH in - UK in – CH out - UK out – CH in - UK out – CH out  The de minimis criteria are re-applied for each situation of these geographical scopes.  The legal base for this is provided for in Article 3d(3) Directive 2003/87/EC. Please flag any concerns you may have with the data attached to us by 14/08/2020. We also suggest you consult your auctioning colleagues, as relevant. Best regards, DG CLIMA Aviation Team European Commission Directorate-General for Climate Action Unit B3 – International Carbon Market, Aviation & Maritime Calculation of Auction Shares Information for the Member States 101st Climate Change Committee -14 July 2020  Legal basis • The legal basis for the distribution of auction revenues lies in Article 3d(3) of the ETS Directive: […] The number of allowances to be auctioned in each period by each Member State shall be proportionate to its share of the total attributed aviation emissions for all Member States for the reference year reported pursuant to Article 14(3) and verified pursuant to Article 15. For the period referred to in Article 3c(1), the reference year shall be 2010, and for each subsequent period referred to in Article 3c, the reference year shall be the calendar year ending 24 months before the start of the period to which the auction relates.
