The ship is a bulk carrier / oil tanker / gas tanker / chemical tanker /passengcr ship * and flies the flag of Repiblic of Moldova which is very high / high / medium to high / medium risk* on the current Paris MOU blacklist. Therefore under the provisions of Section 3.10,5 of the Paris MOU, Article 7b of EU Council Directive 95/21/IC as amended by EU Council Directive 200 1/106/IC and the provisions of Article 9a of the Netherlands Port State Control Act, Official Collection, 1997, no. 557, as amended by the Official publication of the Staatscourant’, November 5th 2003, number 214, the ship will be refused further access to any port in the Paris MOU region**, except a port of the ship’s flag State. This refusal of access will become applicable immediately the ship is authorised to leave this port. Your attention is drawn to the provisions of Section 3.12.3 of the Paris MOU and Article 11.6 of EU Council Directive 95/21/EC as amended by EU Council Directive 2001/106/IC which allows access to a specific port in the event of force majeure or overriding safety considerations, or to reduce or minimise the risk of pollution, provided that adequate measures to the satisfaction of the competent authority of such State have been implemented by the company or the master of the ship to ensure safe entry. In order to have the refusal of access lifted you must address a formal request to this Administration. Y request must be accompanied by a certificate or official statement from the flag State administration co that the ship fully complies with all the provisions of the applicable international Conventions (including and STCW). This document must be issued by the Administration and not a recognised organization acting on its behalf. In addition you must include a certficate from the society classing the ship that the co,!forms to its class standards. * The refusal of access will only be lifted following a re-inspection of the ship at an agreed port by Port Control Officers of this Administration and if evidence is provided to its satisfaction that the ship fully with all the provisions of the applicable Conventions. Costs of any re-inspection will be charged to you. Appeal: You have the right to appeal against this refusal of access order in accordance with the provisions of Article 26 of the Netherlands Port State Control Act, Official Collection, 1997, no. 557, as amended by the Official publication of the ‘Staatscourant’, November 5th 2003, number 214. Appeal against the decision of the refusal of access on account of the Port State Control Act may be made by any person who has been directly affected in his interests by this decision. An appeal shall not cause the refusal of access to be suspended. Appeal shall be made to the Minister of Transport, Public Works and Water Management through the Director of the Netherlands Shipping Inspectorate. The appeal shall be made within 6 weeks after the date of refusal of access and shall be written in dutch or english language by letter, telegraph or telefax.
