Ares(2019)3777072 - 13/06/2019 To the Heads of Maritime Administration of EU MSs, Norway, Iceland, Russia and Canada via email only Lisbon, 12 June 2019 Subject: Pilot Project to verify trustfulness of digital certificate information from Flags and ROs available THETIS Dear Sir / Madam, THETIS is an inspection data base, developed, maintained and hosted by EMSA that supports the Port State Control inspection regime foreseen by Directive 2009/16/EC as amended and its four implementing regulations. THETIS serves also as an inspection database to support the provisions of numerous other EU legal acts, which either have amended Directive 2009/16/EC or where PSC Inspections are foreseen. THETIS serves both the EU Member States and the wider region of the Paris Memorandum of Understanding on PSC (Paris MOU) which includes Canada, Iceland, Norway and the Russian Federation. One of the legal acts supported by THETIS is Regulation 391/2009 (EC) on Common Rule and Standards for Recognised Organizations (RO’s), where several reporting requirements from the ROs to THETIS are foreseen. In a way to modernise this with the 13 EU ROs, EMSA has developed an enhanced webservice to facilitate communication of date of issue, date of expiry and date of (re) survey of all statutory certificates as issued by the ROs on behalf of flag States, to all classed ships, as a first step towards digitalisation and better use of eCertificates. A full refresh of 500.000 statutory and class certificates takes place every day covering all the ships classed with the ROs. Information on new ships entering into service, changes of flag (leading to renewal of statutory certificates) and changes of class implying certificate changes are immediately processed to update information submitted to THETIS within 72 hours after changes in the respective RO systems. By way of Proof of Concept (PoC) the same technical arrangement has been made available for those Flag States that issue statutory certificates themselves through a pilot project with the Danish Maritime Authority. This connection will be further enhanced in the coming months, meaning it will be a regular solution available to any interested Flag State. These data are not and should not be considered as electronic certificates as defined by FAL.5/Circ.39/Rev.2 of 20 April 2016 on Guidelines for the use of electronic certificates. During a workshop on Capacity Building Activities, held in Lisbon on 26 and 27 March 2019, it was decided that EMSA will launch a short pilot project, where PSCOs from Member States willing to take part in the project would check for a period of three months if information on certificates provided by ROs and available in THETIS are updated and reliable. The purpose of this pilot project is to gain valuable insight provided by the PSCOs and their hierarchy regarding the usefulness and trustfulness of the information as available in THETIS. This information will be used to decide future enhancement of THETIS and in particular the automated control of pre-loaded digital information, thus fostering desk preparation and reducing administrative burden for PSCOs and industry during inspections. Considering that during the workshop it was also agreed that the possibility to open the pilot project to the non-EU Parties of the Paris MOU should be investigated, EMSA presented the pilot project in the annual meeting of the Paris MoU in May 2019 (PSCC52). The Committee has endorsed the pilot project and agreed that it will last for a period of six months. Based on the information provided above, this letter is to inform you that the pilot project will initiate on 1 July 2019 and will last until 1 January 2020. During this period PSCOs are expected to test and validate that information and data already uploaded by ROs in THETIS is trustful. All relevant instructions on how to retrieve the RO and/or Flag State data in THETIS as well how to fill and communicate the relevant questionnaire are attached to this letter and will be communicated to PSC coordinators. It should be noted that the same verification could be performed by your Flag State Inspectors during Flag State Inspections should you wish to do so. The results will feed into development as well as into the work of Paris MoU Task Force 6 (Database monitoring), Task Force 34 (Training) and Task Force 51 (|Digitalization issues) where appropriate. Noting that all data are available in the ROs and or FS databases, EMSA is currently leading a task force (TF6) within the context of the Paris MoU, aiming at defining a common template, accepted by Flag States and ROs, for the submission of the data contained in Annexes to THETIS. A further development of the webservice will take place during 2019 to facilitate the exchange of such data as well, but the basic feature is fully operational without it.
