Turvalisuse alaste nõuete täitmine
„Rahvusvahelise laevade ja sadamarajatiste turvalisuse koodeksi“, rahvusvahelise konventsiooni
inimelude ohutusest merel koos parandustega ning Euroopa Parlamendi ja Euroopa nõukogu
määruse täitmine.
Tuginedes meresõiduohutuse seaduse § 95 lg 8 p 1 ja lg 9, sadamaseaduse § 14 lg l, rahvusvahelise
konventsiooni inimelude ohutusest merel koos parandustega (SOLAS 74/88) peatüki XI-2 reeglile
9.2.1 ning Euroopa Parlamendi ja Nõukogu määruse (EÜ) nr 725/2004 31. märts 2004 lisas oleva
„Rahvusvahelise laevade ja sadamarajatiste turvalisuse koodeksi“ A osa punktidele 5.1, 5.6, 5.7,
7.6, 7.8, 9.2, 9.4, 9.5, 10.1, 13.3, 13.4 ja 13.5 annab Veeteede Amet täiendava juhendmaterjali
nõuete täitmiseks.

Security related requirements
In accordance with the requirements of the International Code for the Security of Ships and of
Port Facilities, the International Convention for the Safety of Life at Sea as amended and the
relevant Regulation of the European Parliament and of the Council.
Under the provisions of clause 95 (8) 1) and of subsection 95 (9) of the Maritime Safety Act,
subsection 14 (1) of the Ports Act, regulation 9.2.1 of Chapter XI-2 of the Convention for the
Safety of Life at Sea as amended (SOLAS 74/88) and of sections 5.1, 5.6, 5.7, 7.6, 7.8, 9.2, 9.5,
10.1, 13.3, 13.4 and 13.5 of Part A of the International Code for the Security of Ships and of Port
Facilities (the ISPS Code) as Annex of Regulation (EC) No 725/2004 of the European Parliament
and of the Council, the Estonian Maritime Administration issues the following instructions.

Annex 3. Guidelines for the development and approval of the ship security plan
Each ship to which apply the International Code for the Security of Ships and of Port Facilities (ISPS
Code), the Convention for the Safety of Life at Sea as amended (SOLAS 74/88) and Regulation (EC)
No 725/2004 of the European Parliament and of the Council shall have a ship security plan in an
approved electronic format or paper copy, which is developed on the basis of ship security assessment
and which provides three security levels.
(1) The company shall be responsible for preparation and submission for approval of the ship security
plan.
(2) The ship security plan shall be written in the designated working language in ISPS matters, or the
working language of the ship. If the working language used is not English, the translation of the
ship security plan into English shall be added on the ships flying the flag of Estonia.
(3) The Estonian Maritime Administration, or a recognized security organization on behalf of the
Estonian Maritime Administration, shall approve the ship security plan and the translation (if
applicable). The recognized security organization shall not be involved with the preparation of
the security plan concerned or carrying out of the ship security assessment, based on which the
ship security plan was prepared.
(4) The Estonian Maritime Administration will issue a “Ship Security Plan Approval Letter” and it
shall be available on board together with the International Ship security Certificate (or the Interim
International Ship security Certificate).
(5) If the company wants to introduce changes or amendments to the ship security plan or to any
security equipment specified in the approved plan, then prior to implementation certain provisions
in the plan relating to section 9.4 part A of the ISPS Code have to be approved.
Relevant clauses from section 9.4:
1) A/9.4.2 - identification of the restricted areas and measures for the prevention of unauthorized
access to them;
2) A/9.4.4 - procedures for responding to security threats or breaches of security, including
provisions for maintaining critical operations of the ship or ship/port interface;
3) A/9.4.5 - procedures for responding to any security instructions Contracting Governments
may give at security level 3;
4) A/9.4.7 - duties of shipboard personnel assigned security responsibilities and of other
shipboard personnel on security aspects;
5) A/9.4.15 - procedures to ensure the inspection, testing, calibration, and maintenance of any
security equipment provided on board;
6) A/9.4.17 - identification of the locations where the ship security alert system activation points
are provided; and
7) A/9.4.18 - procedures, instructions and guidance on the use of the ship security alert system,
including the testing, activation, deactivation and resetting and to limit false alerts.
(6) Parts of ship security plan which are not described in this Annex clause 5 do not require approval
before implementation, but the company can submit those for review.

(7) Review and approval of changes or amendments to the ship security plan shall be handled as
described in this Annex clause 1 and clause 3. The Estonian Maritime Administration will issue
a letter “Approval of changes and amendments to the Ship Security Plan” and it shall be available
on board together with the International Ship security Certificate (or the Interim International
Ship security Certificate) and the initial “Ship Security Plan Approval Letter”.
(8) Activities listed in section 10 of Part A of the ISPS Code shall be documented and the relevant
records maintained. On ships flying the Estonian flag at least the last 10 records of every such
activity shall be kept on board.
(9) Ships are required to have security incident reporting systems in place, which must be detailed in
the ship security plan. These systems must cover aspects of incident reporting:
1) enabling shipboard personnel to report security incidents to the ship security officer;
2) enabling ship security officers and company security officers to report security incidents to the
port facility security officer, to the Estonian Maritime Administration and other relevant
authorities (e.g. Estonian Police and Border Guard Board, Estonian Rescue Board).

Annex 4. Guidelines for security incident reporting
In accordance with subsection 6 (1) of Regulation of the Government of the Republic of Estonia No.
39 of 24.03.2016 “Procedure for Provision and Receipt of Security Information of Ports, Port
Facilities and Ships” the Estonian Maritime Administration as the competent authority for maritime
security and the focal point gives the following instructions:
(1) Bomb warnings. If a bomb warning is considered credible, and action such as search or
evacuation is initiated, the Estonian Maritime Administration must be notified immediately. In
the case of a bomb threat that is not considered credible, immediate notification is not required.
A full record of each incident shall be retained for possible future evaluation.
(2) Incidents of which the media are aware. If the media become aware, or are believed to be
aware, of an incident or occurrence, it is important that the Estonian Maritime Administration is
notified immediately.
(3) Discovery of explosives. Discovery of explosives on board of a ship must be reported to the
Estonian Maritime Administration immediately.
(4) Discovery of firearms and ammunition. For definition and classification of firearms the
Weapons Act Chapter 2 has to be taken into account:

classification of ammunition the Weapons Act Chapter 2 has to be taken into account.
Where the discovery of firearms or ammunition involves suspicion that their carriage was
intended for the purpose of endangering passengers, crew or the ship, and further action is
initiated, this must be reported to the Estonian Maritime Administration within 24 hours.
(5) Discovery of explosives component parts. This incident type includes the discovery of the
component parts of an explosive device such as the detonator. For obvious reasons batteries are
not considered to be a part of an explosive device unless there are other components present.
Where the discovery of such components involves suspicion that their carriage was intended for
the purpose of endangering passengers, crew or the ship, and further action is initiated (e.g. by
the Estonian Police and Border Guard Board, Estonian Rescue Board), this should be reported to
the Estonian Maritime Administration within 24 hours.
(6) Unauthorized access to Restricted Areas. This incident type covers all cases when an individual
gains an unauthorized access to a Restricted Area within the ship.
Where an unauthorized access involves suspicion that the access was intended for the purpose of
endangering passengers, crew or the ship, and further action is initiated (e.g. information
submitted to the Estonian Police and Border Guard Board, a full ship search initiated), this must
be reported to the Estonian Maritime Administration immediately.
(7) Hijack. The hijack of any ship must be reported to the Estonian Maritime Administration
immediately.
(8) Other security incidents. If the ship security officer or company security officer considers it
necessary to inform the Estonian Maritime Administration of any other security incident, this
must be done as they consider appropriate.

Scheme “Reporting the security incidents”
When immediate notification of a security incident is required, the Vessel Traffic Management
Department of the Estonian Maritime Administration must be informed at first by phone and then by
fax or e-mail.
Incidents which require notification within 24 hrs may be reported to the Vessel Traffic Management
Department only by fax or e-mail.
When notification is made by e-mail to the Vessel Traffic Management Department e-mail address

Annex 5. Guidelines for training, drills and exercises
Each ship to which apply the International Code for the Security of Ships and of Port
Facilities (ISPS Code), the Convention for the Safety of Life at Sea as amended (SOLAS
74/88) and Regulation (EC) No 725/2004 of the European Parliament and of the Council
shall ensure on board training for shipboard personnel to have sufficient knowledge and
ability to perform their assigned duties on all security levels. To ensure effective
implementation of the ship security plan drills shall be carried out. Ensuring effective co-
ordination and implementation of ship security plans, exercises shall be ensured by the
company security officer.
(1) To ensure effective implementation of the ship security plan, drills should be conducted
at least once every three months, taking account of the type of ship, changes in ship’s
personnel, port facilities visited and other circumstances.
In addition, in cases where more than 25 per cent of the ship’s personnel have been
changed, at any one time, with personnel that have not previously participated in any
drill on that ship within the last 3 months, a drill should be conducted within one week
of the change.
Taking account of the provisions established by section 13.4 part A of the ISPS Code,
drills shall be carried out on board the ship according to different scenarios, and the drills
should test individual elements listed in section 8.9 part B of the ISPS Code.
Relevant clauses from section 8.9:
1) B/8.9.1- damage to, or destruction of, the ship or of a port facility, e.g. by explosive
devices, arson, sabotage or vandalism;
2) B/8.9.2- hijacking or seizure of the ship or of persons on board
3) B/8.9.3- tampering with cargo, essential ship equipment or systems or ship’s stores;
4) B/8.9.4- unauthorized access or use, including presence of stowaways;
5) B/8.9.5- smuggling weapons or equipment, including weapons of mass destruction;
6) B/8.9.6- use of the ship to carry those intending to cause a security incident and/or
their equipment;
7) B/8.9.7- use of the ship itself as a weapon or as a means to cause damage or
destruction;
8) B/8.9.8- attacks from seaward whilst at berth or at anchor; and
9) B/8.9.9- attacks whilst at sea.
(2) Various types of exercises, which may include participation of company security
officers, port facility security officers, representatives of relevant authorities and ship
security officers, shall be carried out at least once each calendar year with no more than
18 months between the exercises.
These exercises should test communications, co-ordination, resource availability, and
response measures. These exercises may be:
1) full-scale and live;
2) table-top simulations or seminar; and
3) combined with other exercises held, such as search, rescue or emergency response
exercises.

Lisa 1. Juhised turvadeklaratsiooni täitmise kohta
Turvadeklaratsioon on kokkulepe, mis on sõlmitud laeva ja sadamarajatise või laeva ja teise laeva
vahel, millega määratakse kindlaks mõlema osapoole kohustused turvalisuse nõuete tagamisel.
(1) Turvadeklaratsioon täidetakse Veeteede Ameti poolt heaks kiidetud vormis, mis on leitav
Veeteede Ameti koduleheküljel https://veeteedeamet.ee/et/meresoidu-ohutus/mereturvalisus .
(2) Turvadeklaratsioon täidetakse juhul, kui seda peab vajalikuks sadamarajatise turvaülem, laeva
turvaülem või teise laeva turvaülem, millega laeval on kokkupuude, vastavalt ISPS koodeksi
A/5.2 sätetele.
Laev peab nõudma turvadeklaratsiooni täitmist järgmistel juhtudel:
1) kui laeva turvatase on kõrgem kui sadamarajatise oma;
2) kui laeva turvatase on kõrgem kui temaga liidestunud teise laeva oma;
3) kui laev liidestub teise laevaga, millelt ei nõuta kooskõlastatud laeva turvalisuse plaani
olemasolu ega rakendamist;
4) kui sadamarajatisel puudub kooskõlastatud turvalisuse plaan;
5) kui laeval või sadamarajatisel on toimunud turvaintsident või on ilmnenud selle toimumise
oht;
6) kui laev asub sadamarajatisel, millelt ei nõuta kooskõlastatud sadamarajatise turvalisuse plaani
olemasolu ega rakendamist;
7) kui seda nõuab Veeteede Amet;
8) kui seda peab vajalikuks laeva turvaülem.
Soovitav on vältida turvadeklaratsioonide täitmist muudel juhtudel (nt. laeva ja sadamarajatise
ühesuguse turvataseme puhul).
(3) Pideva turvadeklaratsioonide täitmise vajadusel (nt regulaarliinide, regulaarsete pukseerimis-, ja
punkerdamisoperatsioonide puhul) võib deklaratsiooni kehtivuse ajaks määrata kuni 6 kuud.
(4) Deklaratsioonis sisalduva teabe muutumisel täidetakse uus turvadeklaratsioon.
(5) Eesti Vabariigi territooriumil asuvates sadamarajatistes ja Eesti riigilippu kandvatel laevadel
tuleb täidetud turvadeklaratsioone säilitada vähemalt 3 aastat.
(6) Enne turvadeklaratsiooni täitmist turvatasemel 3, tuleb sellest teavitada Veeteede Ameti
Laevaliikluse korraldamise osakonda.
(7) Turvadeklaratsiooni täitmisest keeldumisest tuleb viivitamatult teatada Veeteede Ameti
Laevaliikluse korraldamise osakonda.

Lisa 2. Juhised turvalisuse eelteate edastamise kohta
Turvalisuse eelteade (edaspidi eelteade) on informatsioonikogumik, mida laevad millele rakendub
„Rahvusvaheline laevade ja sadamarajatiste turvalisuse koodeks“ (ISPS koodeks), peavad enne
sisenemist Euroopa Ühenduse territooriumil asuvasse sadamasse esitama.
(1) Eesti Vabariigi territooriumil asuvasse sadamasse sisenemisel edastatakse eelteade Elektroonilise
mereinfosüsteemi kaudu veebiaadressil https://www.emde.ee/vi-iloginedit .
(2) Eelteade edastatakse:
1) vähemalt 24 tundi enne sadamasse saabumist;
2) hiljemalt lahkumisel eelmisest sissesõidusadamast, kui reisi kestus on alla 24 tunni;
3) kui sissesõidusadam muutub reisi kestel, siis koheselt uue sissesõidusadama selgumisel,
(3) Eelteade Euroopa Ühenduse territooriumil asuvasse sadamasse sisenemisel tuleb täita liikmesriigi
poolt heaks kiidetud vormis või selle puudumisel Veeteede Ameti poolt heaks kiidetud vormil,
mis on leitav Veeteede Ameti koduleheküljel https://veeteedeamet.ee/et/turvalisuse-eelteate-
vabastus
(4) Eesti Vabariigi territooriumil asuvasse sadamasse sisenemisel edastatakse eelteade Veeteede
Ameti poolt heaks kiidetud vormis sisalduvas andmete mahus lõikes 1 nimetatud veebiaadressil
(vormi juurde ei saa üles laadida faili).
(5) Eelteate edastab laeva kapten, laeva turvaülem, laevaagent või reederi esindaja.
(6) Vastavalt Euroopa Parlamendi ja Nõukogu määruse (EÜ) nr 725/2004 31. märts 2004 artiklile 7
võib liikmesriik taotleda teiselt liikmesriigilt eelteate edastamise vabastust rahvusvahelisi
regulaarliine sooritavatele laevadele.
Täpsem info reederitele või nende esindajale juhindumiseks eelteate vabastuseks koos kontaktidega

Lisa 3. Juhised laeva turvaplaanide koostamise, kooskõlastamise ja turvaplaanides käsitlevate
toimingute säilitamise kohta
Igal laeval kes peab vastama „Rahvusvahelise laevade ja sadamarajatiste turvalisuse koodeksi“ (ISPS
koodeks), rahvusvahelise konventsiooni inimelude ohutusest merel koos parandustega ning Euroopa
Parlamendi ja Nõukogu määruse (EÜ) nr 725/2004, nõuetele peab olema kooskõlastatud
elektrooniline või paberkujul turvaplaan, mis on koostatud laeva turvalisuse riskianalüüsi alusel ja
milles on ette nähtud kolm turvataset.
(1) Reeder vastutab laeva turvaplaani koostamise ja kooskõlastamiseks esitamise eest.
(2) Laeva turvaplaan koostatakse laeva mereturvalisuse tõhustamiseks määratud töökeeles või laeva
töökeeles. Juhul kui laeva töökeeleks ei ole inglise keel lisatakse Eesti riigilippu kandval laeval
turvaplaani tõlge inglise keeles.
(3) Laeva turvaplaan ja selle tõlge peab olema kooskõlastatud Veeteede Ameti või Veeteede Ameti
nimel volitatud turvalisusorganisatsiooni poolt. Volitatud turvalisusorganisatsioon ei tohi olla
seotud antud turvaplaani koostamisega või antud turvaplaani aluseks olnud turvalisuse
riskianalüüsi läbiviimisega.
(4) Veeteede Amet väljastab laeva turvaplaani kooskõlastuslehe, mida säilitatakse laevas koos laeva
turvalisuse tunnistusega.
(5) Kui reeder soovib muudatusi laeva kooskõlastatud turvaplaanis või plaanis määratletud
turvaseadmete osas siis turvaplaani osad, mis on seotud ISPS koodeksi A osa 9.4 allpool loetletud
punktidega ei rakendata enne, kui kõnealuseid muudatusi ei ole kooskõlastatud.
Need on:
1) A/9.4.2 - piirangualade määratlemine ja meetmed, millega välistatakse loatajuurdepääs
kõnealustele aladele;
2) A/9.4.4 - turvaohtudele või turvanõuete rikkumistele reageerimise kord, sealhulgas sätted
laeva või laeva ja sadama vahelise liidese oluliste toimingute jätkamiseks;
3) A/9.4.5 - riiklikule turvaalastele juhendamistele reageerimise kord turvatasemel 3;
4) A/9.4.7 - turvalisuse eest vastutavate laevapere liikmete ülesanded ja teiste laevapere liikmete
kohustused turvalisuse küsimustes;
5) A/9.4.15 - laeval asuvate turvaseadmete ülevaatuse, katsetamise, taatlemise ja hoolduse
tagamise kord;
6) A/9.4.17 - laeva turvahäire süsteemi sisselülituspunktide asukohad;
7) A/9.4.18 - laeva turvahäire süsteemi kasutamise kord.
(6) Laeva turvaplaani osad mis ei ole käsitletud lõikes 5 ei nõua eraldi kooskõlastamist, kuid reeder
võib esitada need kooskõlastamiseks.
(7) Muudatuste kooskõlastamisel lähtutakse lõige 1 ja lõige 3 nõuetest ning Veeteede Amet väljastab
laeva turvaplaani muudatuste kooskõlastuslehe, mida säilitatakse laevas koos laeva turvalisuse
tunnistuse ja turvaplaani kooskõlastuslehega.

(8) ISPS koodeksi A/10 toodud laeva turvaplaanis käsitletavad toimingud tuleb dokumenteerida ja
säilitada, Eesti riigilippu kandvatel laevadel tuleb säilitada iga sellise toimingu kohta vähemalt
10 viimast sissekannet.
(9) Laeva turvaplaanis peab olema täpselt kirjas turvaintsidentidest teavitamise kord. See kord peab
võimaldama ja tagama:
1) laevapere liikmel turvaintsidendist teavitamise laeva turvaülemale;
2) turvaintsidentidest teavitamise laeva turvaülemal ja reederi turvaülemal sadamarajatise
turvaülemale, Veeteede Ametile ning teistele vastavatele ametiasutustele (nt Politsei- ja
Piirivalveamet, Päästeamet).

Lisa 4. Juhised turvateabe äratundmiseks ja turvaintsidentidest teavitamiseks
Vabariigi Valitsuse määruse 24.03.2016 nr 39 “Sadama, sadamarajatise ning laeva turvateabe
edastamise ja vastuvõtmise kord” § 6 lg 1 alusel annab Veeteede Amet järgmised juhised:
(1) Pommiähvardused. Kui pommiähvardus on tõsiseltvõetav ning algatatakse vastav toiming (nt
pommiotsing, evakueerimine vms), siis tuleb sellest koheselt teavitada Veeteede Ametit.
Pommiähvarduste korral, millal oht ei ole tõsiseltvõetav ning vastavaid toiminguid ei algatata,
teavitatakse sellest Veeteede Ametit niipea kui võimalik. Juhtunu tuleb hilisemaks hindamiseks
dokumenteerida.
(2) Turvaintsidendid, millest meedia on teadlik. Kui meedia on teadlik või arvatakse olevat teadlik
ükskõik millisest laeval toimunud turvaintsidendist, siis tuleb sellest koheselt Veeteede Ametit
teavitada.
(3) Lõhke seadeldise avastamine. Kui laeval avastatakse lõhke seadeldis, siis tuleb sellest koheselt
Veeteede Ametit teavitada.
(4) Relvade või laskemoona avastamine. Relvade liigitamisel lähtuda relvaseaduse 2. peatükist
https://www.riigiteataja.ee/akt/129062018056?leiaKehtiv. Laskemoona liigitamisel lähtuda
relvaseaduse 2. peatükist. Kui laevalt avastatakse relv või laskemoon, mille puhul on kahtlus, et
seda on kavatsus kasutada kuritegelikul eesmärgil ning võetakse kasutusele täiendavad meetmed
(nt relva konfiskeerimine, politsei teavitamine), siis tuleb sellest teavitada Veeteede Ametit 24
tunni jooksul.
(5) Lõhkeseadeldise komponentide avastamine. Lõhkeseadeldise komponentidena võib käsitleda
lõhkeaineid, mida ei ole kantud lastinimekirja, detonaatoreid vms. Patareisid ei ole mõistlik
käsitleda lõhkeseadeldise komponendina ilma teiste komponentide olemasoluta. Kui laevalt
avastatakse lõhkeseadeldise komponent, mille puhul on kahtlus, et seda on kavatsus kasutada
kuritegelikul eesmärgil ning võetakse kasutusele täiendavad meetmed (nt Päästeameti ja/või
Politsei- ja Piirivalveameti teavitamine), siis tuleb sellest teavitada Veeteede Ametit 24 tunni
jooksul.
(6) Loata juurdepääs laeva piirangualadele. Kui laeval avastatakse, et keegi proovib kuritegelikul
eesmärgil saavutada või on saavutanud loata juurdepääsu mõnele laeva piirangualale ning
kasutusele võetakse täiendavad meetmed (nt Politsei- ja Piirivalveameti teavitamine, terve laeva
läbiotsimine), siis tuleb sellest koheselt Veeteede Ametit teavitada. Kui toimub loata juurdepääs
laeva piirangualadele, millal oht ei ole tõsiseltvõetav ning täiendavaid meetmeid kasutusele ei
võeta, tuleb sellest teavitada Veeteede Ametit niipea kui võimalik.
(7) Kaaperdamine. Laeva kaaperdamisest tuleb koheselt teavitada Veeteede Ametit.
(8) Muud turvaintsidendid. Kui laeva turvaülem või reederi turvaülem peab vajalikuks teavitada
Veeteede Ametit mõnest muust laevaga turvalisusega seonduvast intsidendist, siis võib seda teha
vastavalt oma äranägemisele.

Turvaintsidentidest, mis nõuavad teavitamist 24 tunni jooksul, võib Laevaliikluse korraldamise
osakonda teavitada ainult faksi või e-posti teel.

Lisa 5. Juhised väljaõppe, õppuste ja harjutuste läbiviimiseks
Igal laev, kes peab vastama „Rahvusvahelise laevade ja sadamarajatiste turvalisuse koodeksi“
(ISPS koodeks) rahvusvahelise konventsiooni inimelude ohutusest merel koos parandustega ning
Euroopa Parlamendi ja Nõukogu määruse (EÜ) nr 725/2004 nõuetele, peab tagama laevas
väljaõppe, õppuste ja harjutuste läbi viimise eesmärgiga anda laevapere liikmetele vilumusi neile
ette nähtud turvalisuse alaste kohustuste täitmiseks kõigil turvatasemetel ja selgitada välja mistahes
turvalisusega seotud ning kõrvaldamist vajavad puudujäägid.
(1) Laeva turvalisuse plaani tõhusa rakendamise tagamiseks teostatakse laeva tüüpi, laevapere
koosseisus toimunud muudatusi, külastatavaid sadamarajatisi ja muid asjaolusid arvestades
õppusi vähemalt kord kolme kuu jooksul.
Sellele lisaks tuleb juhtudel, kui enam kui 25 protsenti laevapere liikmetest on vahetunud, igal
sellisel korral hiljemalt nädala jooksul pärast niisugust muutust, korraldada õppused neile
töötajatele, kes ei ole kolme viimase kuu jooksul samal laeval ühelgi õppusel osalenud.
Võttes arvesse ISPS koodeksi A osa 13.4 viiakse laevas läbi õppusi rotatsiooni korras vastavalt
erinevatele stsenaariumitele, nagu on kirjeldatud ISPS koodeksi B osas 8.9.
Need on:
1) B/8.9.1- laeva või sadamarajatise kahjustamine või hävitamine, nt lõhkeseadeldiste,
süütamise, sabotaaži või vandalismi tõttu;
2) B/8.9.2- laeva kaaperdamine või pardal viibivate inimeste pantvangi võtmine;
3) B/8.9.3- lasti, laeva põhiseadmete või-süsteemide või laeva varude rikkumine;
4) B/8.9.4- loata laevalepääs või laeva loata kasutus, kaasa arvatud piletita sõitjad ;
5) B/8.9.5- relvade või seadmete, kaasa arvatud massihävitusrelvade salavedu laeval ;
6) B/8.9.6- laeva kasutamine turvaintsidendi kavandajate ja/või nende varustuse veoks;
7) B/8.9.7- laeva enda kasutamine relvana või kahjustus,- või hävitusvahendina;
8) B/8.9.8- rünnakud kai ääres või ankrus olevalt laevalt;
9) B/8.9.9- rünnakud merel.
(2) Erinevaid harjutusi, kus võivad osaleda vastavalt nende kättesaadavusele reederi turvaülemad,
sadamarajatiste turvaülemad, vastavate ametiasutuste esindajad ja laevade turvaülemad,
korraldatakse vähemalt kord kalendriaasta jooksul nii, et eelmisest harjutuskorrast ei oleks
möödunud enam kui 18 kuud. Selliste harjutuste käigus kontrollitakse sidepidamist, tegevuse
koordineerimist, ressursside kättesaadavust ja rakendatavaid vastumeetmeid.
Niisugused harjutused võivad toimuda:
1) täiemahulistena ja tegelikes oludes;
2) mudelsimulatsioonide või seminaride kujul;
3) kombineeritult koos muude, näiteks läbiotsimiste korraldamise, päästetööde või vastu
meetmete rakendamise õppeharjutustega.

Annex 1. Guidelines for completion of a Declaration of Security
The Declaration of Security is agreement between port facility and a ship (or between ships) which
address the security requirements that could be shared and shall state the responsibility for each.
(1) Declarations of Security shall be completed using approved form what can be obtained from the
website of the Estonian Maritime Administration https://veeteedeamet.ee/en/forms-declaration-
security .
(2) A Declaration of Security should be completed if it is requested by the Port Facility Security
Officer, Ship Security Officer or Security Officer of another ship that the ship is interfacing with,
in accordance with the provisions of p 5.2 of Part A of the ISPS Code.
A ship must request the completion of a Declaration of Security on the following occasions:
1) the ship is operating at a higher security level than the port facility;
2) the ship is operating at a higher security level than another ship it is interfacing with;
3) the ship is conducting ship-to ship activities with another ship not required to have and
implement an approved ship security plan;
4) the port facility does not have an approved security plan;
5) there has been a security threat or security incident involving the ship or the port facility;
6) the ship is at a port facility which is not required to have and implement an approved port
facility security plan;
7) if it is required by Estonian Maritime Administration;
8) if it is deemed to be necessary by ship security officer or ship master.
It is recommended to avoid completion of Declarations of Security on other occasions (e.g. in
case of similar security levels of the ship and the port facility).
(3) If there is a requirement for continuous completion of the Declarations of Security (e.g. with
respect to regular services, regular towage and bunkering operations) the validity of declarations
may be established for 6 months.
(4) If the information included in the Declaration changes, a new Declarations of Security shall be
completed.
(5) In Port Facilities situated in the territory of the Republic of Estonia and on ships flying the
Estonian flag all completed Declarations of Security must be kept for 3 years.
(6) Before completion of the Declaration of Security on a security level 3, the representative of the
ship shall notify Vessel Traffic Management Department of Estonian Maritime Administration
thereof.
(7) The representative of the ship shall notify the Vessel Traffic Management Department of Estonian
Maritime Administration immediately of the refusal of completion the Declaration of Security.

Annex 2. Guidelines for submitting security information prior to entry into a port
Security information prior to entry into a port (a pre-arrival notification) is information provided by
ships to which International Code for the Security of Ships and of Port Facilities (ISPS Code) applies
and they have to submit this information if they have intention to enter a port of a Member State of
European Union.
(1) The pre-arrival notification prior to entry into an Estonian port shall be submitted via the
Electronic Marine Information System found on the web-address https://www.emde.ee/vi-
iloginedit.
(2) The pre-arrival notification shall be provided:
1) at least 24 hours in advance of entry into port;
2) at the time the ship leaves the previous port if the voyage takes less than 24 hours;
3) as soon as the port of call becomes known if the port of call is not known or if it is changed
during the voyage.
(3) With intention to enter a port of a Member State of European Union the ship shall submit the pre-
arrival notification in format approved by this Member State following their procedures. In
absence of format and procedures Estonian Maritime Administration approved form can be
obtained from the website https://veeteedeamet.ee/en/exemptions-providing-security-

(4) With intention to enter a port of a Estonia the ship shall submit information according approved
pre-arrival notification form via the Electronic Marine Information System mentioned at clause
1 (File uploading is not possible with the form).
(5) The pre-arrival notification shall be submitted either by the captain, the ship security officer, the
agent or another representative of the Company.
(6) In accordance Regulation (EC) No 725/2004 of the European Parliament and of the Council
Article 7 when an international scheduled service is operated between two or more Member
States, any of the Member States involved may request of the other Member States that an
exemption from pre-arrival notification can be granted to that service.
