Annex 1 – Technical specifications
Public procurement “Purchase of the FHIR profiling tool, training course and
consultations”
1. Purpose of the public procurement
The Health Information System is a national database managed and developed by the
Health and Welfare Information Systems Centre (TEHIK), bringing together the health data
transmitted by healthcare providers. Data exchange in the current Health Information
System is document-based, implementing the HL7 CDA standard as the basis for data
exchange. However, document-based data exchange no longer meets today's needs and
does not support the implementation of the strategy for developing and implementing
state-organised event services. Consequently, a decision has been taken to transfer to the
HL7 FIR, a standard that is much more flexible and supports event-based data exchange.
On the roadmap for updating the Health Information System and the related data
exchange, the first project to involve the implementation of the FHIR is the development
of the pregnancy event service, but other projects expecting the introduction of the FHIR
will also be added to the roadmap from the year 2023 onwards, which is why it is important
to fulfil the necessary preconditions for the implementation of the FHIR-based data
exchange in 2022 already. The preparatory work for the transition to the FHIR-based data
exchange (approval of the composition of national base resources, profiling, agreeing on
the principles for profiling and publication) is the responsibility of the respective profiling
steering group set up for this purpose. In order to carry out the activities of the steering
group, the contracting authority needs the additional resources described in clause 2.
2. General requirements
2.1. The object of the public procurement is the purchase of the licences and
product support for the products Forge and Simplifier included in the product
family offered by Firely (hereinafter: Products), the HL7 FHIR profiling training
course (hereinafter: Training) and the HL7 FHIR consultation service
(hereinafter: Service).
2.2. Warranties and product support will be provided in accordance with the
manufacturer's terms and conditions.
3. Requirements for profiling and profile publication software
3.1. The Product shall cover the basic functionality of the processes related to
profiling (profiling, linking to code lists, profile validation and publication).
3.2. The duration of the right to use the Product shall be one calendar year.
3.3. The Product shall be accompanied by instructions for use for new users.
3.4. The Product shall allow for user rights and product support for up to ten (10)
users.

3.5. If the provider of the Product is notified of any errors in the use of the product,
the provider shall respond and eliminate the error in accordance with the
product support details given in the public price list

3.6. The contracting entity wants to start using the software in February. If the
parties conclude the contract at a later date, the period shall be extended
accordingly, given that the contractor must be prepared to deliver the product
for use as soon as possible after the conclusion of the contract.
4. Requirements for the profiling training
4.1. The purpose of the Training is to increase the FHIR profiling competence of
TEHIK's personnel in the performance of their duties.
4.2. The content of the Training shall correspond to the content of the profiling
training course announced by the provider (https://fire.ly/training/hl7-fhir-
profiling-course/), but shall be adapted to the following requirements:
4.2.1.1. The tool used for the Training shall be Forge/Simplifier, i.e. it must be
possible to perform the practical tasks given to participants using these
tools.
4.2.1.2. The sample profiles generated at the Training shall be based on a health
information system service.
4.3. The Training shall be carried out in one group, with a total of 10–15 people
attending. If not everyone is able to participate, the contracting entity shall be
allowed to record the training course to be viewed later.
4.4. The Training shall take place in February or March 2022. The Training shall be
held between 9 am and 5 pm EET (Eastern European Time). The dates of the
Training shall fall between 21 February and 11 March 2022, either on
consecutive days or on specified days, once a week for three weeks.
4.5. The Training shall be held online over three days.
5. Requirements for the consultation service
5.1. The contracting authority defines the Service as the provision of consultations
for the contracting entity in the validation of profiles, as well as the provision of
experience-based knowledge of best practices in the implementation of HL7
FHIR in the following areas:
• Profiling and profile validation;
• Publication of profiles and implementation guides;
• Terminology;
• Analysis and, where appropriate, modification of existing work
processes;
• Documentation.
5.2. A consultant providing the Service must have experience in advising other
organisations on the implementation of HL7 FHIR, the designation of the base
resources and the validation of profiles.

5.3. The consultant providing the Service shall be added to the contracting entity's
profiling working group, which will meet once a week for up to one hour
(presumably from the conclusion of the contract to the end of May). The
expected volume of consultations within this period is up to 25 hours, but this
number is not binding on the orders. Consultations will be ordered as needed
and the contracting authority will not be required to pay for a fixed number of
working hours.

The Health and Welfare Information Systems Centre hereby invites you to submit a tender
in the negotiated public procurement procedure without prior publication of a tender
notice “Purchase of the FHIR profiling tool, training course and consultations”.
1. General requirements
1.1. The content and specifications of the object of the procurement have been laid out
in the invitation to tender and in the annex “Technical specifications” (Annex 1).
1.2. By submitting a tender, the tenderer declares that
1.2.1. it accepts all terms and conditions described in the procurement documents
and undertakes to perform the work subject to the procurement under the
conditions specified by the contracting authority. The submission of variants
is not allowed;
1.2.2. it has the intellectual property rights required for the performance of the
public contract;
1.2.3. the tender shall be valid for a minimum period of 90 calendar days from the
time limit for the submission of tenders;
1.2.4. it is not subject to the grounds for exclusion as set out in 95 § (1) of the Public
Procurement Act. If the contracting authority learns of the existence of any
grounds for exclusion of the tenderer, the contracting authority may exclude
the tenderer from the public procurement and refuse to award a public
contract to such tenderer.
1.3. Where appropriate, the tenderer shall indicate the part of its tender which is a
business secret. If the tenderer has not specified a business secret, the contracting
authority shall assume that the tender does not contain any business secrets.
1.4. The contracting authority shall open the tenders after the time limit set for the
submission of tenders has expired.
2. Requirements for the content of the tender, and verification of suitability
2.1. A tender is declared admissible if it complies with all requirements set out in the
tender documents.
2.2. To verify suitability, the contracting authority may ask the tenderer for further
clarifications about the tender, which the tenderer undertakes to respond to within
3 working days at the latest.
2.3. The contracting authority may declare a tender suitable if it does not contain any
substantive deviations from the requirements specified in the tender documents.
2.4. The following shall submitted as part of the tender:
2.4.1. Filled-in value form (Annex 2);
2.4.2. The tenderer’s contractual terms and conditions, including standard
terms and conditions, for the provision of the service;
2.4.3. A description of the content of the training course to be purchased, the
training plan and the dates of the training course within the time period
requested by the contracting authority;
2.4.4. The consultant's CV showing his or her previous experience in advising
organisations implementing the FHIR standard;
2.4.5. Details of the contractual contact person and the signatory (may be
included in the draft contract submitted).
3. Assessment of tenders
3.1. A tender is declared successful if it complies with all the requirements established
and the proposed value is appropriate with regard to the budgetary resources of the
contracting authority.
4. Rejection of tenders and declaration of the procedure invalid
4.1. The contracting authority rejects and will not assess the tender(s) that:
4.1.1. do not meet one or several of the requirements given in the procurement
documents or if it is not possible to unambiguously verify the suitability of the
tender from the tender or the clarifications, or if the tenderer has submitted
false information;
4.1.2. has/have not been submitted within the time limit;
4.1.3. if the contracting authority does not have the budgetary resources needed to
finance the performance of the contract.
4.2. If there is a justifiable need, the contracting authority may declare the procurement
procedure invalid on its own initiative. Justifiable needs may include, in particular, the
following:
4.2.1. the need to substantially change the object of the contract;
4.2.2. the requirements on which the procedure is based have significantly changed
and, therefore, the award of the contract proves unnecessary or impossible;
4.2.3. the inconsistencies found in the procedure cannot be eliminated and
therefore, the procedure cannot be lawfully completed.
