Honorable President/Chief Justice,
On 19 March 2022, the 17th meeting of the Bureau of the World Conference on Constitutional Justice
(WCCJ) will take place. According to the Agenda of the meeting, the Bureau will be invited to decide
whether to propose to the General Assembly the suspension of the Constitutional Court of the Russian
Federation and/or the Constitutional Court of Belarus from the World Conference.
In this regard, I hereby inform you that the Constitutional Court of Moldova, as Presiding Court over
the CECC, will vote in favor of proposing to the General Assembly of the WCCJ the suspension of the
membership of the Constitutional Courts of the Russian Federation and Belarus, under Article 9 of the
Statute of the WCCJ.
At the same time, if there are objections to the position of the Constitutional Court of Moldova, please
inform us at
[email protected], by tomorrow, 18 March at 18:00 (Chișinău time).
The relevant provisions of the Statute of the World Conference on Constitutional Justice read as
follows.
According to Article 9 of the Statute of the WCCJ, “[i]n cases of flagrant violation by a member of the
principles on which the World Conference is based (Article 1), the Bureau may submit a written
proposal to the General Assembly for that member’s suspension. Unless one third of the members
object to this proposal within one month of notification having been sent, the suspension enters into
force (Article 4.b.7).”
While members of the World Conference can themselves terminate their membership (Article 9.2), the
Statute does not provide for any termination of membership by the Bureau or the General Assembly.
In case of suspension under Article 9.1 of the Statute, the membership as such remains active and the
suspension can be revoked again at a later stage. In the absence of a specific provision on this, the
suspension can be revoked under the same procedure, i.e. by the General Assembly upon a proposal
by the Bureau.
