Tel. +372 667 2000 -Representative: Kaur Kajak Both contracting parties recognise each other as having the necessary legal capacity to enter into these clauses, in compliance with the GDPR - Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data - and DECLARE: I. That personal data will be transferred to CONSUMER PROTECTION AND TECHNICAL REGULATORY AUTHORITY. II. That CONSUMER PROTECTION AND TECHNICAL REGULATORY AUTHORITY requires from the company ICF certain documents with personal information of employees of the said company, in order to verify the professional qualifications. III. In view of the above statements and in order to comply with the provisions of the RGPD, the parties of this document establish the following clauses, the purpose of which is to regulate the transfer of personal data of ICF employees, by the said company, to the company CONSUMER PROTECTION AND TECHNICAL REGULATORY AUTHORITY. DOCUMENT: PERSONAL DATA PROTECTION CLAUSES_TTJA CLAUSES FIRST. Data and documents subject to transfer -affected or interested parties of said transfer: ICF employees-: I. The Application (free form, ie there is no specific form) - it must be clear what is desired: compliance with a certain Estonian professional qualification. We need: Diploma Railway Engineer, EstQF Level 7, Construction and operation of automatic railway equipment and communication technology; Elective areas of work: Design and design control. II. Copy of the applicant’s identity document (passport, ID-card) or extract of the page thereof, which bears the personal data. III. Copies of the evidence of professional qualifications (applicant submit translations) – diplomas, CV, work experience SECOND: The ICF acts as Data Controller of the data transferred. Upon the transfer of data, CONSUMER PROTECTION AND TECHNICAL REGULATORY AUTHORITY in turn becomes, in the processing of such data, the Data Controller of the data transferred, being obliged to comply as such with the obligations established by the RGPD. THIRD. CONSUMER PROTECTION AND TECHNICAL REGULATORY AUTHORITY may only use the information and documentation provided by ICF to check the professional qualifications of the employees concerned and to validate the official qualifications issued by Spain with the corresponding qualifications in Estonia. FOURTH. The personal data transferred - the subject of these clauses - shall be kept by CONSUMER PROTECTION AND TECHNICAL REGULATORY AUTHORITY for as long as it maintains the contractual relationship with ICF and for as long as they are necessary or relevant for the purpose for which they have been transferred or for compliance with the legal obligations to which it is subject; once they are no longer necessary or relevant for the purpose for which they have been transferred or for compliance with legal obligations, the company CONSUMER PROTECTION AND TECHNICAL REGULATORY AUTHORITY undertakes to cancel them. FIFTH. CONSUMER PROTECTION AND TECHNICAL REGULATORY AUTHORITY undertakes not to disclose to third parties the data subject to transfer - as referred to in this document - without the prior written consent of the interested party, with the exception of the transfers required by the legislation in force. My name is Juan Arnés García and I am an engineer working in ICF Spanish company. ICF is a Railway company specialized in the design and construction of Level crossing systems. In December 2019 ICF won and signed a contract with EVR to design and install 112 Level crossing during the next 5 years. ICF has started the process of design collaborating with local design companies in order to know better Estonian regulations and designing processes. We are now interested in the qualification of our own engineers in order to be able to sign our own designs as we have done in many other countries.
