UNLAWFUL ESTABLISHMENT OF “SAMOA INTERNATIONAL MARITIME
AUTHORITY” (“SIMA”)
I, Vaaelua M. Nofo Vaaelua, Secretary for Transport under Section 6 of the Ministry of
Transport Act 1978 and, Chief Executive Officer/Secretary for Transport for the Ministry of
Works, Transport and Infrastructure established under the Ministerial and Departmental
Arrangements Act 2003 as they apply to the Ministry of Works, Transport and Infrastructure do
hereby in response to a publication by a Captain Ahkasit Subcharoen who introduced himself as
Merchant Marine Director of Merchant Shipping of Samoa who has set up the so-called “Samoa
International Maritime Authority” (“SIMA”) for ships registration and crew certification.
I believe this has been widely circulated by this Mr. Ahkasit Subcharoen in Thailand and a Mr.
Hesham Qutef in London, UK especially through their website www.maritimesamoa.com.
In my capacity as Chief Executive Officer/Secretary for Transport responsible for the lawful
administration of all Maritime matters for the Government of the Sovereign State of Samoa, I
hereby give notice that by authority vested in me to delegate certain maritime functions under
Samoa’s Shipping Act 1998, no delegation had been issued to any person, Shipping/Crew
Agencies or Companies outside Samoa to establish or operate an entity such as SIMA and to
perform functions in respect of ships registration and crew certification.
SIMA has quite clearly carried out an illicit operation in a fraudulent, misleading and an
intentionally false manner to the detriment of Samoa’s sovereignty and in doing so have
committed serious offences under Samoa’s shipping legislations.
Samoa now calls for all those concerned both regionally and internationally not to recognize
SIMA as representing Samoa's shipping interests and any person appointed or operating
thereunder will be doing so illegally and fraudulently by virtue of the pertinent provisions
provided above.
Further SIMA has also without our authorisation used the name, flag and crest of Samoa on its
website www.maritimesamoa.com which is illegal under our relevant laws and must now close
forthwith.
SIMA has misrepresented the sovereignty of our good nation and we intend to use all means
available to inform and stop the illegal activities of SIMA and any other person or group
purporting to represent Samoa's shipping interests without the authorisation of the Government
of Samoa.
