Pakkumus vastab hanke tingimustele ja kehtivatele standarditele Hanke tehniline kirjeldus sätestab, et: „ATS keskseade peab olema dubleeritud emaplaadiga. Ühe keskseadme piires paikneva emaplaadi vea korral peab kogu süsteemi töö jätkuma.“ Kuigi terminoloogiliselt on kasutatud sõna „dubleeritud emaplaat“, ei ole hankenõudes määratletud, et dubleerimine peab toimuma füüsilise, identse emaplaadi kaudu. Nõude sisuline eesmärk on süsteemi töökindluse tagamine ja signaalitöötluse jätkumine rikke korral. Pakutud Detnov CAD-250 keskseade vastab sellele nõudele, kuna: • see vastab standarditele EN 54-2 ja EN 54-4, mis reguleerivad automaatse tulekahjusignalisatsiooni juhtseadmete töökindlust ja hädaolukorra käsitlust; • süsteemis on rakendatud modulaarne dubleeriv töötlemismehhanism, mis võimaldab rikke korral käivitada eraldi töötlemise häda- või degradeeritud režiimis; • süsteem säilitab vajalikud häiresignaalid ja aktiveerib väljundid ilma viivituseta, tagades hanke eesmärgi täitmise. Tootja on selle kinnitanud ametlikus kirjalikus seisukohas ning olemas on ka Euroopa vastavussertifikaat. 2. Pakkumus ei ole kõrvaldamise alusel tagasi lükatav Pakkumus on koostatud kooskõlas hanke alusdokumentidega ning esitatud on kõik nõutavad dokumendid. Vastavalt Riigihangete seaduse § 114 lg 1 saab pakkumuse tagasi lükata üksnes juhul, kui see ei vasta kehtestatud tingimustele või õigusaktidele. Käesoleval juhul: • tehniline lahendus täidab esitatud funktsionaalsed tingimused; • pakutud seade vastab asjakohastele Euroopa standarditele; • puudub alus pakkumuse tagasilükkamiseks või edukuse tühistamiseks.
