After a thorough deliberation we have to inform you that unfortunately EFSI cannot terminate the contact based on mutual agreement due to the fact that the transportation trucks delivered clearly did not meet the requirements set in the tender. We do acknowledge the concern of Labochema regarding the note that has to be made in the Estonian Public Procurement Register. However as there has been a breach of contract we cannot make an exception as it would be violation of the equal treatment principle and therefore the Estonian Public Procuremetn Act. We also would like to indicate that the note in the registrer does not automatically lead to elimination of Labochema from future tenders.
