Draft AGREEMENT between the Telecommunication Administration of the Russian Federation and the Telecommunication Administration of the Republic of Estonia on the Use of the Frequency Bands 151.7125-154.0125 MHz and 154.9875-156.0125 MHz by Stations in the Land Mobile Service and in the Fixed Service in Border Areas City, year In accordance with Article 6 of the ITU’s Radio Regulations, the Telecommunication Administration of the Russian Federation and the Telecommunication Administration of the Republic of Estonia, hereinafter, the Parties, acting with a view to preventing harmful interference and optimizing the use of frequency spectrum, enter into this Agreement on the Use of the Frequency Bands 151.7125-154.0125 MHz and 154.9875-156.0125 MHz by Stations in the Land Mobile Service and in the Fixed Service in Border Areas . 1. The Principles 1.1. This Agreement is based on the concept of coordination field strength threshold levels and the concept of preferential frequency channels (hereinafter, channels) for land mobile service and fixed service stations. 1.2. The Parties’ preferential channels in the frequency bands 151.7125-154.0125 and 154.9875-156.0125 MHz and the channels’ center frequencies spaced at 12.5 kHz are shown in the Annex to this Agreement. 1.3. The frequency assignments to land mobile service stations and to fixed service stations using the frequency band 151.7125-154.0125 and 154.9875-156.0125 MHz whose coordination has been successfully completed by the Parties as of the effective date of this Agreement shall keep their status. 2. Use of Frequency Bands without Coordination 2.1. Either Party may use its preferential channels without coordination with the other Party if the station’s field strength does not exceed 12 dBμV /m 80 km deep into the territory of the State of the other Party. 2.2. Either Party may use the other Party’s preferential channels without coordination with the other Party if the station’s field strength does not exceed 12 dBμV /m on the borderline between the States of the Parties. 2.3. Either Party may use shared channels without coordination with the other Party if the station’s field strength does not exceed 12 dBμV /m on the borderline between the States of the Parties. 2.4. Either Party may use channels with a frequency spacing different from 12.5 kHz within its preferential channels without coordination with the other Party subject to compliance with the conditions set in item 2.1 of this Agreement . 2.5. Either Party may use channels with a frequency spacing different from 12.5 kHz within the other Party’s preferential channels and shared channels without coordination with the other Party subject to compliance with the conditions set in items 2.2 and 2.3 of this Agreement . 3. General 3.1. If the field strength of a station exceeds the level in items 2.1-2.5 of this Agreement, as appropriate, the frequency assignment in question must be coordinated with the other Party. 3.2. The coordination request format shall be consistent with the ITU Radiocommunication Bureau’s Circular letter No. CR/118 dated 31 March 1999. 3.3. Coordination of a frequency assignment shall not take more than 65 days from the date of receipt of the coordination request by e-mail and/or by fax. If no reply is received during that period, the requesting Party shall send a reminder stating that the coordination request review period has expired. If no reply is received within 20 days from the date of receipt of the reminder, the frequency assignment shall be deemed coordinated. 3.4. Field strength values shall be calculated using the latest version of ITU-R Recommendation Р .1546. 3.5. Field strength values shall be calculated for a receiving antenna height of 10 m above ground for 10% of the time and for 50% of the locations. 3.6. If harmful interference is caused by a station covered by this Agreement, the Procedure of ITU Radio Regulations Article 15 section VI shall be applied. The Party with jurisdiction over such station shall, upon receipt of a harmful interference report, take immediate action required to eliminate the interference and advise the other Party accordingly. 4. Modification and Termination of the Agreement 4.1. Additions and/or changes to this Agreement may be made by mutual agreement of the Parties. 4.2. Either Party may terminate t his Agreement by giving a six months’ notice to the other Party in writing . 4.3. In case of termination all coordinated assignments remain valid. 5. Entry into Effect This Agreement shall become effective on the day of approval by the Telecommunication Administrations of the Russian Federation and the Republic of Estonia. This Agreement is executed in the English language, in two originals, one for each Party.
