Answer to your inquiry
Dear Marek Domagala
Please find the answer to your query on the legal system of the Republic of Estonia and the
case law of the Esīonian Supreme Court.
1) Is the fact that the law prescribes only a non-custodial penalty (e,9. a fine) for a
particular minor criminal offence of any relevance as regards the admissibįlity or
validity of a police officer's arrest (detention) of a person suspected of committing the
said criminal offence?
Yes, it is. The factthat the law prescribes only a non-custodial penalty for a particular minor
criminal offence has relevance regards the admissibility/validity of a police officer's arrest
(detention).
Pursuant to $ 3 of the Estonian Penal Code
offences arę divided into
criminal offences and misdemeanours.
A criminal offence is an offence which is provided for in the Penal Code and the principal
punishment prescribed for which in the case of natural persons is a pecuniary punishment or
imprisonment and in thę case of legal persons a pecuniary punishment'
A misdemeanour is an offence which is provided for in the Penal Code or another act and the
principal punishment prescribed for which is a fine, detention or deprivation of driving
privileges.
Procedure and basis of detention are different depending on offence (criminal offence or
misdemeanour).
The Code of Misdemeanour Procedure
a. 090 018006/conso provides for the extra-judicial
and court procedure for misdemeanours and for execution of the punishments imposed for
misdemeanours.
