On the Framework agreement of 15.09.2023,

Dear addressees,
The Latvian Ministry of Defence, as well as the Estonian Centre for Defence Investments, Estonian
Defence Forces, Estonian Defence League, Estonian Police and Border Guard Board as buyers, and
SCANIA Eesti AS, and SCANIA CV AB as sellers have entered into the Framework agreement of
15.09.2023, No 2-2/23/658-1.
We are informing you that the Latvian Ministry of Defence is undergoing defence procurement reform,
wherein most administrative and logistical procurement functions will be centralized in a single
governmental entity – the State Centre for Defence Logistics and Procurement.
According to Clause 16.6. of the Framework Agreement it is therefore necessary for the parties to
provide written consent to the transfer of its contractual rights and obligations arising from the
Framework agreement by the Latvian Ministry of Defence to the State Centre for Defence Logistics and
Procurement.
In view of the above, and regarding principles of EU public procurement law as applicable to the
Framework Agreement, and in accordance with Clauses 16.5.-16.10. of the Framework Agreement the
respective amendment would constitute a substitution of the Buyer, rather than the admission of a new
contracting authority to the Framework Agreement.
Accordingly, subject to the written consent of party the Latvian Ministry of Defence should be replaced
by the State Centre for Defence Logistics and Procurement as the legal successor to the Buyer’s rights
and obligations arising from the Framework Agreement.
Taking this into account,
1) SCANIA CV AB and SCANIA Eesti AS please provide consent to the transfer of rights and
obligations as mentioned no later than 10 July 2026;

2) Estonian Centre for Defence Investments please provide the conclusion of agreement wherein Latvian
Ministry of Defence is substituted by the State Centre for Defence Logistics and Procurement after
consent to the transfer of rights and obligations is provided.
