Mr Nerijus Jackunas Ntel Solutions OÜ Tööstuse tn 47a-28 10416 Tallinn Our 24. 01.17 No 23-3/ 17-0209 -002 Warning Dear Mr Jackunas According to Electronic Communications Act ( hereafter ECA) § 133 section 1 Estonian Technical Regulatory Authority ( hereafter ETRA) exercises supervision over implementation of ECA. ETRA is also law- enforcement authority in the meaning of law enforcement act § 6 section 1. According to ECA § 32 section 1 1 the holder of a numbering authorisation must ensure the dialling of calls from the numbers described in the Estonian numbering plan or access to the number booked and taken into use under § 38 of this Act and to the provided communications service or other services provided through it. In January 19 and 23, 2017 ETRA carried out control calls from Ntel Solutions OÜ’s mobile numbers in numbering ranges 5429 5000- 5429 5999, 5429 8000-5429 8999, 5603 9000-5603 9999 and 5899 7000-5899 7999 belonging to the Estonian numbering plan (surveillance protocol No. 23-3/17-0209-001) with the purpose of finding out if Ntel Solutions OÜ has ensured the implementation of the above-mentioned requirement of ECA § 32 section 1 1 . The dialability of mobile numbers belonging to Ntel Solutions OÜ on the basis of numbering authorisation No. NLN16/0478 was checked from the networks of Telia Eesti AS (hereafter Telia ), Elisa Eesti AS ( hereafter Elisa) and Tele2 Eesti AS ( hereafter Tele2) . Calling the aforementioned mobile numbers by the use of number robot software returned the network’s automatic message about number non- dialability (“the dialed number is not in use”) which brought us to the conclusion that it was not possible to call Ntel Solutions OÜ’s numbers from number belonging to Telia’s network. Control calls were also made from numbers belonging to Tele2 and Elisa networks. The mobile numbers to be checked were randomly selected from the numbers booked by Ntel Solutions OÜ. Calling all of the selected numbers returned the network’s automatic message about number non- dialability („ the dialed number is not correct , please check the number“, „ the number you dialed is not in use , please check the number before redialing “) which brought us to the conclusion that it was not possible to call to Ntel Solutions OÜ’s mobile numbers also from Tele2 and Elisa networks . Based on the aforementioned surveillance operation results Ntel Solutions OÜ has not ensured the implementation of the above-mentioned requirement of ECA § 32 section 1 1 . Based on the above , please provide your comments about not ensuring the dialability of mobile numbers in Estonian networks by January 31, 2017 at the latest . After this deadline ETRA may issue a precept to Ntel Solutions OÜ to bring the dialling of the mobile numbers described in the Estonian numbering plan into conformity with ECA § 32 section 1 1 . In addition , according to ECA § 37 section 3 point 1 ETRA may revoke the numbering authorisation if the use of the rights granted by the numbering authorisation have not commenced efficiently within six months after the grant of the numbering authorisation .
